The Marriott Hotel Company, the largest hotel company in the world, is the subject of a criminal investigation in Poland. The investigation was opened following Marriott’s puzzling behaviour towards the building owners (LIM Center) where the Marriott Hotel in Warsaw is located.
Monitoring Marriott’s legal history shows that it has often faced legal charges. However, today in Poland, such a serious investigation is taking place, led by the chief prosecutor, that if it goes to court, it could also lead to prison terms for the heads of Marriott, at least in Poland.
How did the hospitality giant Marriott get caught up in a criminal investigation for severe financial offences in Poland?
Marriott’s latest criminal investigation is being conducted by Polish authorities looking into a dispute between the international hotel chain Marriott and the LIM Center. The LIM Center owns the building where the Warsaw Marriott Hotel is located and has filed multiple complaints against the hotel chain. The LIM Center has three main charges.
All the main accusations refer to the conduct of the Marriott Hotel’s international management towards him during the COVID-19 epidemic and the periods of social quarantines, which led the global hospitality industry to a massive financial crisis.
LIM’s first accusation against the Marriott raises suspicion of financial embezzlement. During the Corona period, the Marriott management demanded that the LIM centre keep the hotel open during the first lockdown despite the sharp drop in hotel room bookings during that period. According to LIM, funds from the LIM centre were used to finance the operation of the Marriott hotel. At the same time, Marriott itself did not pay for the operation of maintenance, employees, suppliers, etc.
Worse, according to LIM, many companies that LIM paid to work for Marriott are, in fact, Marriott subsidiaries. Accordingly, LIM claims that the hotel used LIM’s money to pay various Marriott subsidiaries for a variety of services.
This behaviour of the Marriott is the most severe suspicion, which the prosecutor’s office is investigating and hopes will soon reach the court.
Mysterious motives to reduce losses are also at the centre of the criminal investigation against the Marriott.
The second dispute under investigation concerns an ongoing controversy over Marriott International management’s refusal to approve the acceptance of an advertising contract that LIM obtained during the COVID-19 pandemic.
The idea was to place a large advertising space in the Marriott Hotel building to minimize financial losses during the pandemic. The LIM Center claims that due to the lockdown and the epidemic in Poland, even though the hotel was open, most of it was empty and that it was able to find an advertiser who would be willing to pay for extensive advertising space, but one that would not disturb the guests, thus reducing the many daily expenses of keeping such a prestigious hotel open during the pandemic. The stubbornness of Marriott’s international management towards the Polish LIM was uncompromising but without a convincing explanation. Accordingly, whether there is a criminal aspect in causing the losses that Marriott knowingly created for LIM is being investigated.
Marriott almost prevented LIM from becoming an accommodation centre for doctors during the Corona.
In addition to all of these, according to the owners of the building where the Marriott is located, LIM, during the Coronavirus, LIM was able to reach an agreement that the Marriott would host doctors and that the hotel would operate as a medical centre, thus succeeding in bringing profits to the hotel and the building’s owners during a crisis.
However, Marriott strongly opposed this move as well. Still, the property owners’ insistence, LIM, finally led to Marriott’s international management agreeing to this agreement and hosting a medical centre during the Corona. However, LIMs, who tried to reach an arrangement with Marriott, also complained about the conduct of Marriott’s international management on this issue.
The severity of the charges against Marriott.
The charges that the Polish prosecutor is investigating against the Marriott are so severe that, according to Polish law, Marriott managers could face up to 10 years in prison if found guilty. The case reached the prosecutor’s office, but it is now in the courts and will probably end in a settlement.
The central question in the investigation of Marriott following LIM’s accusations is why the company’s international management chose to harm someone who is supposed to be its business partner and, therefore, shares its interests in such a clear way.
It seems that the main reason that led to this behaviour is that Marriott decided to “enjoy” a round deal in which, instead of acting in accordance with the market situation during a global pandemic and closing its hotel in Warsaw, it decided to keep it open because of the commitment of the building’s owners, LIM, to pay the expenses of operating the hotel during the epidemic. But more than that, the LIM company’s money was paid in a roundabout transaction to Marriott and brought it to a profit, which is an illegal operation.
Not the Marriott’s first entanglement
The investigation in Poland is not the first case in which Marriott’s international management faces serious charges. Close monitoring of the company shows that it often brings up cases in which the company is accused of illegal conduct – whether it is an unlawful price-fixing scandal or an attempt to defraud the insurance company. However, Marriott, the largest hotel company in the world, knows how to conduct legal proceedings in front of investigative bodies and the courts and usually end lawsuits with legal settlements. However, as mentioned, the investigation in Poland concerns such serious accusations that perhaps the International Marriott management crossed the border this time.
In conclusion, according to suspicions and much evidence, the largest hotel company in the world saw fit to act criminally against its business partner in Poland. This is particularly serious since it was done during the international crisis caused by the coronavirus epidemic, in which, according to suspicion, she tried to generate profit at the expense of her business partner. This can negatively affect Marriott’s relations with other business partners worldwide.
